Patent troll risk?

Hi, since Iron Speed is discontinued due to a patent troll issue, I am worried if the same could happen to CodeOnTime. Please look into the patent they are referring to (reference: US7062502) and give some assurance before I buy or renew any new licenses?

  • Yes indeed, patent troll. Come on!, Microsoft is also being sued for using a third party "patented" metadata extraction method based on Microsoft's platform, which is, by the way open. Really???

  • Read the letter from ISD mentioning close by 31/12/2015 due to litigation and license cracks etc. Can COT update us on their position as intending to renew license?

  • OK - Assume that their is a patent infringement. Two things now arise:
    1. Payment of back charges
    2. Licensing costs

    I find that this patent could be overturned as prior technology i.e. MS Access. Although, this patent clearly points to SQL.

    If it only point 2 and the cost is NOT prohibitive, then happy to pay additional amount for a great tool. If point 1, your f****d!.

    Patents in the US have a life of 20 years and this one expires in 2021.

    As this affects Microsoft and EVERY OTHER software development company, including products like Telerik, etc. they are going to take some very expensive lawyers to fix this (the US government could overturn this by making software patents invalid or have a 5 year life).

    The problem with IronSpeed was that it peaked 5 years ago, It had an aging product, a large workforce and a reducing market, i.e. they had not listened to the message "Mobile First" and their product was too clunky to migrate. Whereas COT has a strategic direction of Mobile.

    Anyway, we may need some clarification OR something that extracts the structure and then can be imported without directly hitting the SQL tables.

    If I may offer some insight into this situation with 30 years and 4 successful tech startups experience, (including involvement in protracted litigation).

    I have been on ISD's "marketing mailing list" since first evaluating their software vs COT over 5 years ago. Over the past 4-6 weeks I have received sudden, numerous & countless sales offer emails from ISD to buy licenses, including 50% off if you "act now", to "buy one get one free" licenses and etc to name a few.

    After reading today's ISD post link provided above, It's my opinion that ISD's business practices are dubious at best, since anyone that has purchased licenses even "recently" will not receive a refund. One person even posted that they spent $5000 just last week and cannot receive a refund. In my opinion ISD was pursuing a major "cash push" prior to suspending operations.

    The "patent trolls" previously mentioned patented their "idea" in 2001, (yes in 2001). Litigation to fight the patent is expensive and costly no doubt, and the patent holders are obviously looking for some "big" money via lawsuits, (suing microsoft, oracle, salesforce.com etc). However, in my research in the patent lawsuits regarding these cases thus far, I do not believe that the individual defendant litigation costs have exceeded $75k over the course of a year, (I may be wrong but studied the individual case filings, if 75K is it worth suspending operations over?).

    I believe that ISD's software was substandard compared to Cot, and their business practices in the past, present, and depending on what happens in the future may prove my opinion.

    In my experience, the cot team are pretty smart guys. I am sure they will figure out a way to overcome the patent challenge if it directly arises, as they stand to greatly benefit from increased sales volume from previous ISD developers.

    My team has no choice but to remain optimistic as we have over 1 million dollars invested in our cot flagship product. Honest entrepreneurs do not just give up, they fight, they survive.

    Just my opinion/insight and thanks for reading.....
